Terms of Service

1. Agreement to Terms

By creating an account or using TalkEasier ("the Service"), you agree to these Terms of Service ("Terms"). If you do not agree, do not use the Service. We may update these Terms from time to time. If we make material changes, we will notify you at least 30 days in advance by email or through a notice in the Service. Continued use after the effective date of any update constitutes acceptance.

2. Service Description

TalkEasier is an AI-powered dating conversation practice platform. You interact with entirely fictional, computer-generated AI characters to practice and develop social and dating conversation skills. The Service includes practice scenarios, AI-generated coaching feedback, and skill tracking.

All characters, conversations, and coaching feedback are generated by artificial intelligence. No real people are involved in your practice conversations. AI responses are algorithmically generated and may be inaccurate, inappropriate, or unreliable.

3. Not Therapy or Professional Advice

The Service is an educational practice tool. It is not therapy, counseling, medical advice, psychological treatment, or any form of professional healthcare.

• Use of the Service does not create a therapist-patient, doctor-patient, counselor-client, or any other professional-client relationship.
• AI characters and coaching feedback are not substitutes for professional mental health services. If you are experiencing mental health difficulties, please consult a licensed professional.
• Anxiety self-ratings and skill assessments are self-reported personal tracking tools, not clinical instruments. They do not constitute a diagnosis of any condition.
• The Service is not equipped to handle mental health crises. If you or someone you know is in crisis, please contact emergency services or a crisis helpline in your area (for example, the 988 Suicide and Crisis Lifeline in the United States, or ERAN at *1201 in Israel).

4. Eligibility

You must be at least 18 years old to use the Service. By creating an account, you represent and warrant that you are at least 18 years old. We reserve the right to terminate accounts where we have reason to believe the user is under 18.

5. Your Account

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Notify us immediately at support@talkeasier.com if you suspect unauthorized access. We are not liable for losses arising from unauthorized use of your account where you have failed to safeguard your credentials.

6. Acceptable Use

You agree to use the Service in good faith and in accordance with these Terms. You may not:

• Use the Service to develop, practice, or refine harmful, manipulative, coercive, or abusive communication strategies.
• Attempt to extract, reverse-engineer, or reconstruct AI model weights, prompts, training data, or character system instructions.
• Use the Service on behalf of another person without their knowledge or consent.
• Use the Service for any unlawful purpose or in violation of any applicable law.
• Interfere with, disrupt, or place an unreasonable burden on the Service or its infrastructure.
• Create multiple accounts to circumvent usage limits, bans, or subscription restrictions.
• Resell, redistribute, or commercially exploit the Service or its content without our written permission.

We reserve the right to suspend or terminate your account for violations of this section.

7. Intellectual Property

The Service, including its AI characters, scenarios, coaching methodology, training content, software, and design, is the intellectual property of TalkEasier and is protected by applicable intellectual property laws. You may not copy, reproduce, distribute, or create derivative works from any part of the Service without our written permission.

Your conversation data belongs to you. By using the Service, you grant us a limited, non-exclusive, royalty-free license to use anonymized, aggregated data derived from your usage to improve the Service. This license does not permit us to identify you personally from aggregated data.

8. Subscriptions and Billing

The Service offers free and paid tiers. Paid subscriptions are billed on a recurring monthly basis through our payment partner, Polar. By subscribing to a paid plan, you authorize Polar to charge your chosen payment method on a recurring basis until you cancel.

• Cancellation: You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of the current billing period. You retain access to paid features until then.
• Refunds: Refunds are handled on a case-by-case basis. Contact support@talkeasier.com for refund requests.
• Price changes: We may change subscription prices with at least 30 days’ written notice. The new price applies at the start of the next billing period after the notice period.
• Free tier: Access to the free tier may be limited or modified at our discretion.

9. AI-Generated Content

All character responses, conversation reviews, and coaching feedback in the Service are generated by artificial intelligence. You acknowledge and agree that:

• AI-generated content may contain errors, inaccuracies, biases, or inappropriate material.
• AI characters are fictional simulations and do not represent real people or their views.
• Skill assessments and coaching feedback are algorithmic outputs, not professional evaluations.
• We do not guarantee that AI-generated advice or feedback will lead to any particular outcome in real-world interactions.
• Your conversation messages are processed by third-party AI providers to generate responses, as described in our Privacy Policy.

10. Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, store, and share your personal data. By using the Service, you acknowledge that you have read and understood the Privacy Policy.

11. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure, or that AI-generated content will be accurate, complete, or appropriate.

12. Limitation of Liability

To the maximum extent permitted by applicable law:

• We are not liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, goodwill, or other intangible losses, arising from your use of or inability to use the Service.
• We are not responsible for outcomes in your real-world dating, social, or personal life resulting from skills practiced or advice received through the Service.
• Our total aggregate liability for any claims arising from or related to the Service is limited to the amount you paid us in the 12 months preceding the claim, or $100 USD, whichever is greater.

Some jurisdictions do not allow the exclusion or limitation of certain damages. In those jurisdictions, our liability is limited to the greatest extent permitted by law.

13. Indemnification

You agree to indemnify, defend, and hold harmless TalkEasier and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any third party’s rights.

14. Termination

You may close your account at any time through your account settings or by contacting support@talkeasier.com. We may suspend or terminate your account if you violate these Terms, if required by law, or if we discontinue the Service. We will provide reasonable notice where possible.

Upon termination, your right to use the Service ceases immediately. Your data will be deleted in accordance with our Privacy Policy. Sections that by their nature should survive termination (including Intellectual Property, Disclaimer of Warranties, Limitation of Liability, Indemnification, and Governing Law) will survive.

15. Dispute Resolution

Before initiating formal proceedings, you agree to contact us at support@talkeasier.com and attempt to resolve the dispute informally for at least 30 days. If the dispute is not resolved informally, it will be submitted to the exclusive jurisdiction of the courts specified in Section 16.

16. Governing Law and Jurisdiction

These Terms are governed by the laws of the State of Israel, without regard to its conflict-of-law principles. Any disputes arising from or relating to these Terms or the Service will be subject to the exclusive jurisdiction of the competent courts of Tel Aviv-Jaffa, Israel.

If you are a consumer in the European Union, you retain the benefit of any mandatory consumer protection provisions of the law of your country of residence. Nothing in these Terms affects your right to rely on such mandatory provisions.

17. Severability

If any provision of these Terms is held to be unenforceable or invalid, that provision will be modified to the minimum extent necessary to make it enforceable, or if modification is not possible, severed. The remaining provisions continue in full force and effect.

18. Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and TalkEasier regarding the Service and supersede all prior agreements and understandings.
